Waiver and Indemnity Agreement
By registering for and /or participating in the program, event or session identified as Dinners Galore (the “Session”), hosted in whole, or in part, by Dinners Galore, Inc., or any of its affiliates, you hereby agree to the terms and conditions of this Waiver and Indemnity Agreement.

For and in consideration of my participation in the Session, I hereby agree that  I shall not assert any responsibility or liability on the part of Dinners Galore, Inc. or its affiliates and their officers, agents or employees, in any manner whatsoever, for any aspect of the Session.

I will follow all rules of conduct related to the use of the Dinners Galore facilities during my assembly session.  I understand and agree that I will be soley responsible for, and assume the risk of, the food handling procedures which I employ after any food prepared by me is removed from the Dinners Galore premises including, but not limited to:

	The freezing and refrigerating of the food.  Dinners Galore recommends that all food prepared in connection with the Session be taken home immediately after the Session.
	I will maintain refrigerator temperatures at below 40º F and maintain freezer temperature at 0°F or less.
	Fully cook each meal, following the defrosting instructions, cooking instructions, and internal temperature guidelines provided on the label for each entrée.  I will heat all dinners to an internal temperature above 165º F when ready to eat.
	I agree to release Dinners Galore from all claims, damages and causes of action or liabilities which may arise as a result of my preparation, storage and consumption of Dinners Galore dinners, except if soley due to the gross negligence of Dinners Galore.

General
Any claim or action related to these Terms shall be governed by the substantive laws of the State of California, U.S.A., and controlling U.S. federal law, without giving effect to any principles of conflicts of laws, and will be adjudicated in the U.S. District Court for the Northern District of California located in Oakland, California or the state courts located in Alameda County, California.

These Terms represent the entire understanding relating to the use of the Web Site and the Materials and shall prevail over any prior or contemporaneous, conflicting or additional communications. If any provision of these Terms is found to be invalid by any court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining Terms, which shall remain in full force and effect. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision of these Terms. Dinners Galore may revise these Terms at any time without notice by updating this posting on the Web Page. Please contact Dinners Galore with any questions regarding these Terms.
